Unusual Argument Against Gay Marriage

Paul Clement, a prominent attorney representing congressional Republicans in the DOMA case, has issued a brief that states gay couples don't need access to marriage because they can't get accidentally pregnant.  He goes on in his brief to say:  "Because same-sex relationships cannot naturally produce offspring, they do not implicate the State’s interest in responsible procreation and childrearing in the same way that opposite-sex relationships do."

The Obama administration slammed the unusual legal argument now key in the movement against gay marriage.

There are currently two cases that feature this argument prominently, and both cases will be considered by the Supreme Court in the near future.  the first case (March, Hollingsworth v. Perry) is a challenge to Prop 8, the existing ban on gay marriage in California.  The other (United States v. Windsor) is looking to have the Defense of Marriage Act (DOMA) declared unconstitutional.

The Justice Department took an unfavorable view of the argument/brief, stating that "Marriage is far more than a societal means of dealing with unintended pregnancies."

Brokeback Wardrobe on Ebay

Before I go into this story, I want to state that DCF does not know with any certainty that these items are legitmate items, and we are not presenting the story in hopes that a Brokie will buy them, but rather as a point of interest for our members.

There is an EBay user that currently has three lots up for sale on EBay, each lot is a different item that he claims is an original outfit from the movie Brokeback Mountain.

The first item is "Ma Twist's" outfit.  Seen in the movie and worn by Roberta Maxwell, this is the outfit that Ma Twist is wearing when Ennis pulls up to the Twist house.  The second lot is supposed to be the jeans and t-shirt that Ennis is wearing in the "skinny dipping" scene, where the guys strip and jump off the cliff into the lake.  This lot also includes (for some reason) Jack's brown boots.  The last lot is Jack's jeans, t-shirt, tank top, and socks.

If you want to check the items out, you can do so at the link below.

GLAAD Media Awards

The 24th annual GLAAD Media Awards are taking place in New York City on March 16th this year, and a GLAAD spokesperson has revealed that this year's Vito Russo award will be given to Anderson Cooper, and it will be presented to him by Madonna.

The Vito Russo Award is named for the founder of the Gay & Lesbian Alliance Against Defamation, and is presented to open gay, lesbian, bisexual or transgender professionals who have made "a significant difference in promoting equality."

Madonna was asked to present the award because "Madonna has been a passionate spokesperson and longtime supporter of gay rights. She has embraced LGBT people around the world on many occasions. From speaking out against bullying to raising support for marriage equality, Madonna has always been one of our community's strongest allies. We are honored to have her stand with GLAAD and Anderson Cooper."

Pastor in Lesbian Custody Case Sentenced to 27 Months

Kenneth Miller is a Mennonite pastor who was before a judge today (Monday (3/4) and found himself sentenced to 27 months in jail for contempt of court.

Pastor Miller was in court due to his part in a kidnapping case.  He was approached by Lisa Miller (no relation) and her 17 month old daughter.  Lisa Miller had been in a lesbian relationship which she had broken off, saying she was no longer a lesbian, and refusing to let her former partner (Janet Jenkins) to see their daughter.

Jenkins had no biological connection to the little girl, but the couple was in a civil union when the girl was adopted, and a judge determined that Jenkins had legal rights.  When Lisa Miller attempted to keep Jenkins from seeing the girl, Jenkins went to court to get legal custody.

Lisa Miller approached Pastor Miller for help, and he drove Lisa and her daughter across the Canadian border, and refused to testify against others who were determined to know where Lisa Miller went.  It's believed she and the little girl are in Nicaragua.

Firefighter/Model Gets Probation

NY firefighter and underwear model Taylor Murphy has been sentenced to five years probation for violating a protective order against his transsexual girlfriend.

The 28-year-old underwear model was the subject of a scandalous trial, where he was accused of beating up Claudia and choking her. He was eventually cleared of those charges.

The judge presiding over the case gave Murphy a break, he could've been sentenced for 4 years instead of getting probation.  He was fired from his position with the NY fire department, but since he got no jail time, Murphy's attorney is attempting to get him a certificate of relief, which would allow NYFD to hire him back.

Shifting GOP Winds on Gay Marriage?

Last week, over 130 prominent Republicans signed a friend-of-the-court brief urging the U.S. Supreme Court to rule that California’s Proposition 8 law is unconstitutional. The court is set to hear arguments on the matter March 26th.

Nicolle Wallace, former Communications Director for President George W. Bush, says this is a sign that the Republican Party is getting ready to move forward in favor of gay marriage.  “Good politics are usually borne out of good policies and there is a recognition that we need a base of policies that appeal to a broader swath of America.”

However, others point out that when  one reviews the list of people who signed the brief, only two of the signers are currently elected officials.

A Washington Post-ABC News poll back in November showed that the base of the party remains resistant to change with 54% of Republicans “strongly opposed” to gay marriage.

Gay Group Calls for Apology From Scottish Cardinal

A Scottish cardinal who stepped down from church leadership after admitting sexual misconduct should apologize to gay people for his years of "vicious and cruel language" about them, Britain's leading gay-rights group said Monday.

Cardinal Keith O'Brien resigned last week as Britain's most senior Roman Catholic and admitted to "inappropriate behaviors" with priests.

Ben Summerskill, chief executive of the gay rights organization Stonewall, said Monday that the group noted "with sadness that the cardinal didn't find it in him to apologize to gay people, their families and friends for the harm his vicious and cruel language caused."

That view was echoed by veteran human rights activist Peter Tatchell, who urged the cardinal "to show true remorse for his homophobia and hypocrisy by saying sorry to the gay community for the hatred and harm he has caused — and by publicly repenting his homophobia."

Rally At the Supreme Court in DC

On Tuesday, March 26th, a rally for Marriage Equality will be taking place between 8:30am - 11:30am.

The date was picked because that is the day that the court will begin hearing the case on Prop 8.

Particpants are asked to wear red, to show support of the repeal of Prop 8.

Two DCF members (GoaBoyDC & CellarDweller115) have confirmed they will be at the rally that Tuesday.

Beyond Brokeback In The Media

On March 7th in Phoenix, Arizona, a staged performance of Beyond Brokeback, The Impact Of A Film took place at the Burton Barr Central Library.

The performance included staged readings from Beyond Brokeback, and music from the CD Meet Me On The Mountain.

The event was covered by Echo Magazine, and if you would like to read their article on the event, please click the link below.  It will open the page to the cover of the magazine.  In the white box at the top, change the number to "18" and it will open to the article.

Beyond Brokeback - With a Real Brokie

As we had stated in past issues of TDS, Bobby (forum member Bobby19in1963) would be taking part in the staged readings, marking the first time that a "real-life" Brokie was on stage with the show.

The reading was also attended by BayCityJohn (John) and KillersMom (Linda).  John was able to upload a video of the performance to YouTube, so all forum members can see the show.  Both John and Linda were introduced to the crowd, and Linda went on stage at the end of the performance to give a small statement about her Brokeback experience.

Madonna attacked by "Little Monsters"

The 24th annual GLAAD Media Awards announced that Madonna will be presenting Anderson Cooper with the Vito Russo award.  This move has angered the "Little Monsters", the fans of Lady Gaga.

A letter was drafted to GLAAD asking them to "reconsider" their invitation to Madonna, and went so far as to blame Madonna for the AIDS crisis, claiming she encouraged gay men to have unprotected sex, which further spread the HIV/AIDS virus.  They further state that if GLAAD officials don't rethink their choice of having Madonna as a presenter, the group has vowed to "strike back" in an unspecified way in their letter.  They go on to say that Lady Gaga is a true gay rights activist, and she should be given this honor.

The irony in this whole thing is that Madonna has long been a gay rights supporter, and one of the first major celebrities to talk about the rights of AIDS patients, the support they need, and included information about safe-sex in her Like A Prayer CD.  She's also supported a number of AIDS related charities, as well as giving proceeds from her concerts, and was given an award from AmFar for her work.

Oz Tops The Box Office!

Oz:  The Great & Powerful opened this weekend.  There were big expectations for this film being the first "blockbuster" of 2013, and the film did not disappoint in terms of numbers.  The opening weekend figures were over $80 million.

However, reviews for the film have been somewhat mixed.  Some reviewers loved the effects, others found them "distracting" and "gaudy".  Almost all the reviews have claimed that James Franco was miscast as the Wizard, and his performance is not what it should be.

Reviewers have been kinder to Milla Kunis (The Wicked Witch) and Michelle Williams (Glinda the Good Witch), acknowledging their good performances in their roles.

Russia Gets Its First Lesbian Glossy

Russia has an anti-gay propaganda law in place, and violence towards GLBT people is on the rise.  However, that hasn't stopped from the first ever lesbian magazine from being published.

The new magazine is called Agens (which means "driving force" in Latin) and it will feature personal coming out stories, fashions, and will hopefully give a sense of community to the LGBT community that is dealing with an information black-out.

The Agens top editor also doesn’t see the publication as a provocation, but as an opportunity to engage directly with Russian lawmakers: “We are aiming at a dialogue both with the readers and the authorities,” Chernyavskaya said. “If the deputies are unhappy with the magazine, I would like to talk to each of them face to face.”

Being Seen:  Video Diaries of Transgender Youth

Margaret Talbot has written an article for The New Yorker.  She discusses how she was working on an article on transgender youths, and turned to You Tube, only to find thousands of videos posted by transgender youths chronicling their own transitions.

The videos offer a mash-up of youthful identity struggles, self-promoting confessionals, and thoughtful explorations of gender and its discontents. Often shot in poster-covered bedrooms or in the family basement, on wavering Webcams, they range from diary-like accounts to pop-ballad-accompanied photo montages and practical tutorials on subjects like makeup for M.T.F.s (male-to-females) or binding (compressing breasts) for F.T.M.s.

Gay Marriage in New Zealand

The country of New Zealand is getting closer to making same-sex marriage legal.

The speed of the law change has shocked some conservative groups and religious groups.  One theologian said it could contribute to the dilution of marriage into a "faint nothingness".

"We are simply a voice that is saying ... please listen to those who still want to uphold the historic Judeo-Christian value as has been understood over many years."

But for a majority of submitters, gay marriage was overdue in New Zealand. Proponents argued the state was discriminating in restricting marriage to heterosexual couples, a policy which had influenced high rates of mental illness among young gay New Zealanders. Civil unions were "parallel, but not equal" to marriage, submitters argued.

Tribal Same-Sex Bill OK'd

With an exchange of rings and a kiss, two men became spouses Friday during a ceremony at a northern Michigan Indian reservation after the tribal chairman signed a measure approving same-sex marriage in a state where it's officially banned

In the state of Michigan, an Indian Reservation has held a same-sex marriage, even though this is banned in the state of Michigan.

Tim LaCroix, 53, wed longtime partner Gene Barfield, 60 in a ceremony that blended traditional sounding vows with Native American symbolism and music.  Tim LaCroix is a member of the Little Traverse Bay Bands of Odawa Indians.   The men, who live in Boyne City, acknowledged the state of Michigan does not recognize their union but said they hoped the tribe's approval would be one more step toward acceptance across the U.S. Federally recognized Native American tribes are self-governing and not bound by the state law.

Senator Has Change of Heart

Senator Robert Portman (R) was a staunch supporter of the Defense of Marriage Act (DOMA) and against gay marriage.  That all changed last week, when he announced he was now supporting gay marriage.  The reason behind his change of heart was that his son came to him, and came out to him.

In a series of interviews, Senator Portman stated that he didn't want his son to be treated differently than anyone else, and that "if two people are prepared to make a lifetime commitment to love and care for each other in good times and in bad, the government shouldn’t deny them the opportunity to get married."

Gay Marriage Support Hits New High

According to a Washington Post/ABC News poll, support for gay marriage has hit an all time high.  In 2004 41% of Americans polled believed that gay marriage should be legalized, while 55% believed it should be illegal.  Those numbers have flipped, with 58% of Americans polled believing that gay marriage should be legal, while 38% believing it should be illegal.

Among young adults age 18 to 29, support for gay marriage is overwhelming, hitting a record high of 81 percent  in the new poll. Support has also been increasing among older adults, but those aged 65 years old and up remain opposed, on balance: 44 percent say same-sex marriage should be legal; 50 percent say illegal.

There has been a related movement in public opinion about homosexuality. Fully 62 percent of Americans now say being gay is just the way some people are, not something people choose to be. About 20 years ago, fewer than half of the public said so.

Honey Boo Boo Mom & GLAAD Awards

The 24th annual GLAAD Media Awards were Saturday night, and many people were surprised to see a made-over June Shannon on the red carpet.

June Shannon is better known as the mother of "Honey Boo Boo" (Alana) a child pageant contestant with a big dose of personality.  A regular on the TV series Toddlers & Tiaras, Alana proved so popular that she and her family were given their own spin-off, Here Comes Honey Boo Boo.  The series made headlines last year when a new episode aired against the Republican National Convention, and beat them in the ratings.

June Shannon has recently lost 100 pounds, and was wearing a gown and diamonds for the awards.  She was there because the show was nominated for an award for Best Reality Series and the positive way they portray gay people.   Alana's uncle is on the show, and is an out gay man.  The little girl has said she believes everyone is "a little bit gay" and calls her uncle by the nickname "Uncle Poodle", after hearing an adult woman in the pageant business refer to her gay friends as poodles, saying "I love all my poodles."

Lee Thompson (Uncle Poodle) is on the show on a regular basis, often helping Alana with her pageants.

School Accused of Discrimination

A San Bernardino County school district faces legal action for alleged discrimination against gay and lesbian students.”

GLBT students at Sultana High School in California are claiming that they are being discriminated against by the faculty and administration at the school.  Some of their claims are:   lesbian students will not be allowed to wear tuxedos to the prom,  failing to investigate discriminatory remarks by the faculty, and censorship of announcements and activities of the Gay Straight Alliance at the school.

One example of the last item:  A planned announcement of: “Do you identify as straight, lesbian, bisexual, gay, or are you questioning everything? Come join Sultana’s Gay-Straight Alliance on Wednesdays at lunch in room W-11. Join a group of students here on campus that support each other and want to make a difference for others.”  was changed to:  “GSA meeting in W-11.”

Question Of The Week

Last Week's Question:  What TV show is the longest running hour-long television series featuring all female leads?

Kathy made a guess of Charlie's Angels.  That show had a rotating cast of women, and was on the air for 5 seasons.  Good guess, but not the answer.  The correct answer is Charmed.

Charmed was on the air from 1998 to 2006, a total of 8 seasons.  Seasons 1 - 3 starred  Shannen Dougherty as Prue Halliwell, Holly Marie Combs as Piper Halliwell, and Alyssa Milano as Phoebe Halliwell.  The three sisters move into their grandmother's manor after she dies, and find a chest in the attic called "The Book of Shadows" which reveals the sisters are witches, and it is their destiny to protect humanity from evil.

After the third season started, trouble began between Dougherty and Milano.  Doughtery allegedly said "it's her or me!" and with that, Dougherty was fired.  Seasons 4-8 starred Rose McGowan as Paige Matthews, an unknown half-sister who turned up after Doughtery's character (Prue) was killed in a battle with a demon.

Gay Teen Burned to Death

18 year old Steven Simpson (L) was celebrating his birthday with friends.  The party was crashed by 20 year old Jordan Sheard.

Simpson (who was autistic) was drunk and had been dared to strip down to his boxer shorts.  Sheard began to berrate Simpson, and used a marker to scrawl homophobic slurs on his stomach and arm.  Sheard then went and got a bottle of tanning oil from Simpson's bedroom, and squirted it all over Simpson.

Chants of "light it, light it" were shouted, and Sheard flicked the lighter on, and put it to Simpson's groin, who was then engulfed in flames.

Another party goer tried to extingquish the flames, but Simpson had received 3rd degree burns over 60% of his body, and died the next day at the hospital.  Sheard at first denied any part of the incident, but then admited it.  He was sentanced to only 3 years & 6 months behind bars for manslaughter.

Rally At the Supreme Court in DC

This week is the week the big rallies at the Supreme Court are taking place.  Most people are expected to appear on the 26th (Tuesday) which is the day that the Court hears the case on Propisition 8, which banned same-sex marriage in California.

For those who can't make it on Tuesday, a second gathering is behing held on Wednesday (27th) which is the day that the court will begin hearing the case on DOMA (Defense of Marriage Act).

Of course, both sides of these debates are hoping they will win, and a number of news articles have said that the decisions can go either way.

Attendees have been asked to wear red in a show a solidarity, and supporters who can not be at the rallies have been asked to wear red during the day, no matter where they are.

Two DCF members (GoaBoyDC & CellarDweller115) have confirmed they will be at the rally that Tuesday, and pics will be posted both on DCF and BetterMost, as CD115 is a member of both forums.

Hip-Hop Artist Supports Gay Marriage

Ben Haggerty is better known by his stage name, Macklemore.

Macklemore has been in the music business since 2000, when he released his self-distributed EP "Open Your Eyes".  Since then, he's released mix tapes and two full-length CDs, but not on a major label.  In 2008 Macklemore met up with producer Ryan Lewis and they've been working together ever since.

Macklemore released his last CD, "The Heist" and it entered the Billboard Top 200 album chart at #2.  The CD's last single, "Thrift Shop", hit #1 on the Billboard Hot 100 chart, and sold over $2.2 million copies.

Macklemore is a gay marriage supporter, something of a rarity in the hip-hop scene, and has even released a video for his song "Same Love", which follows the story of a baby, growing into an adult, and finding a partner and having a commitment ceremony.

Transgender Students Get Unisex Bathroom Option

Grant High School in North Portland, Oregon, has announced that they've created six unisex bathrooms in the school, in response to concerns from transgender students uncomfortable with traditional bathrooms.

Officials say four student restrooms and two staff restrooms -- all single-stall -- will be open to all students but create another option for the five to 10 transgender students at the high school, Portland Public Schools' largest.

Transgender rights has become a more prevalent concern in recent years as such situations become more common. In Colorado, a family is suing a school district for not allowing a transgender elementary-school student who identifies as a female to use the girls bathroom. In Arizona, a bill could require people to use only restrooms designated for the gender on their birth certificates.

The outline of the story, as we know it, is that the indie western produced by and starring Natalie Portman was set to begin shooting this past Monday, but that Ramsay didn’t turn up to direct on the day. Producer/financier Scott Steindorff spoke out via Deadline, saying he was “shocked” at the director’s behavior.

Producer/financier Scott Steindorff is now scrambling to find a replacement for Jude Law, who left when Ramsay didn't turn up.  Actors being looked at to replace Law include Jake Gyllenhaal, Tobey Maguire, and Jeff Bridges.

Question Of The Week

Last Week's Question:  According to TV Guide, what was the first Realty TV Series?

An American Family is an American television documentary filmed from May 30 through December 31, 1971 and first aired in the United States on the Public Broadcasting Service (PBS) in early 1973. After being edited down from about 300 hours of raw footage, the series ran one season of 12 episodes on Thursday nights at 9:00 p.m.

Originally intended to be a chronicle of the daily life of the Louds, an upper-middle-class family in Santa Barbara, California, the groundbreaking program documented the break-up of the family via the separation and subsequent divorce of parents Bill and Pat Loud.  The documentary inspired the MTV reality television series The Real World.

Thailand's Mixed Same-Sex Marriage Messages

In the forum's Gay Marriage thread you will find a recent post by tfferg that features an opinion piece on the state of same-sex marriage in Thailand.

In the piece (which appears in The Bangkok Post) the author discusses a society that has straight and gay massage palors side by side, transgender celebrities and politicians, and yet homosexuals may not donate blood, and how there appears to be very little reasoning behind the way people and society feel about sexuality and the rights of GLBT citizens.

A recent poll showed that 58% of the people responding felt that same-sex marriage was a bad example for children, yet there is a segment of Thailand society that embraces homosexuals,  accepting homosexual singers, electing transgender politicians and having successful homosexual talk show hosts.

Rush Limbaugh Says Gay Marriage is "Inevitable"

Conservative talk-show host Rush Limbaugh has recently made statements that he believes that no matter what the Supreme Court decides in June, that gay marriage is now "inevitable", but not because that's how it should be.

Rush believes that the inevitablity began when discussions started attaching "other words" to marriage.  According to Rush, by definition gay people can't be married, because marriage is defined as a union between a man and a woman, and therefore, gay people can not be married.  However, once the terms "same-sex marriage" and "gay marriage" began to appear in our language, it opened the door for gay people to get married.

Rush goes on to state that he believes that the term 'marriage' was not intended to be a discrimanatory term, but it has evolved into one, and that is why arguments to maintaining the status quo of marriage will fail.

NOM Will Demand Same-Sex Marriage Ban

In a recent radio interview with conservative talk radio host Steve Deace, Brian Brown - the president of NOM (National Organization for Marriage)- made a statement saying that if the Supreme Court makes a decision that favors the gay community, that NOM's next step will be to demand that a federal ban on same-sex marriage be written into the Constitution of the United States.

Brown goes on to say that he believes his side will win these cases (Prop 8 & DOMA, which were heard by the Supreme Court on 3/26 & 3/27) but that they are determined to carry on with the amendment if indeed they do lose.

Amending the US Constitution is not easy, and will take many years and much money to do so.

Same-Sex Legal Kit for Dummies

We're all familiar with the "for Dummies" series.  The instructional book series was launched in 1991 with the title "DOS for Dummies."  It started out as a technology series, and has evolved, now including such titles as "Acne for Dummies," "Chess For Dummies," and "Fishing For Dummies."

Seeing a need in the market, Carrie Ross-Stone (a West Virginia attorney) partnered with Widener University School of Law professor John G. Culhane to write "Same-Sex Legal Kit for Dummies."

The book is a compilation of legal information every LGBT person, whether single or partnered, needs to know.  The book comes with a CD that contians sample legal documents such as tenant agreements, living wills, co-parenting agreements, and medical powers of attorney, and provides state-by-state information regarding marriage rights, civil-unions, and adoption rights.

You Scream, I Scream, We All Scream For Big Gay Ice Cream

Warmer temperatures are coming (really, they are!) and that means ice-cream!

We all have memories of the ice-cream truck, or going to the ice-cream parlor and getting our favorite flavors.  If you are in the NYC area and have a trip to the East or West Village planned, you can stop at Big Gay Ice Cream!

With two locations (East Village, 125 East 7th Street, between 1st Avenue & Avenue A  & West Village, 61 Grove Street, at Seventh Avenue South) Big Gay Ice Cream is selling some outrageous sounding cones and sundaes.  You can get the Monday Sundae (vanilla/chocolate ice-cream twist in a nutella coated cone with dulce de leche and sea salt) or a Mermaid (vanilla ice-cream, key lime curd, crushed Graham crackers & whipped cream).

April 13th in NYC there will be a Brokie dinner (see the link below in the Brokie Gatherings section) and perhaps we'll stop at Big Gay Ice Cream for dessert, and give you a personal review.

Anne Hathaway To Star In Laggies

With her Best Supporting Actress win behind her, Anne Hathaway is moving on to her next project.

In "Laggies," Anne Hathaway plays Megan who is described as a "perpetually adolescent late 20 something" who is completely thrown by her boyfriends marriage proposal.  She pretends to leave on a job retreat, but instead hides out with her best friend, a 16 year old girl named Annika (played by Chloe Moretz).

It’s been a busy year so far for Shelton. After its premiere at this year’s Sundance Film Festival, Magnolia picked up her latest effort "Touchy Feely" for worldwide distribution. Ang Lee Shares His Life & Experiences

Academy award-winning director Ang Lee spent some time talking about his life after he completed his time in the graduate film program at the Tisch School of the Arts.  After the successes of "Crouching Tiger, Hidden Dragon," "Brokeback Mountain," and "Life of Pi" it may be hard to imagine Lee's life as a struggle, but that's the story that Lee tells.

In the linked interview below, Lee talks about his time in "development hell," his time in school, projects with Spike Lee and some of his professors.

While Lee believes there is no set advice for aspiring filmmakers — and what works for one person may not work for another — he places emphasis on the importance of writing and asking for feedback.

Gay Marriage Support in All 50 States

A new report published by the UCLA's Williams Institute shows that support for gay marriage has risen in all 50 states.

The report, “Public Support for Marriage for Same-Sex Couples by State," shows that over the past eight years, every U.S. state has increased in its support for same-sex marriage, with an average increase of 13.6 percent, and if the public opinion trends continue at the same pace, eight additional states will be above 50 percent support by the end of next year.

Meanwhile, a LifeWay Research study released in March found that nearly two-thirds of Americans believe legalized same-sex marriage in the U.S. is inevitable.

Jeremy Irons Responds To Gay Marriage Controversy

Jeremy Irons is an English actor who has been in many notable films, and won an Academy Award for Best Actor in 1990 for his role in Reversal of Fortune.

In an April interview, Jeremy was asked about same-sex marriage, and his reply was:  "Could a father not marry his son?"  When the interviewer pointed out that incest is against the law, Jeremy replied:  "it's not incest between men. Incest is there to protect us from inbreeding, but men don't breed."    He went on to discuss using gay marriage in this way to avoid taxation, and worried about changing marriage.

Response was immediate, and it resulted in Jeremy issuing a statement to 'clarify' his position:

"Perhaps rather too flippantly I flew the kite of an example of the legal quagmire that might occur if same sex marriage entered the statute books, by raising the possibility of future marriage between same sex family members for tax reasons, (incest being illegal primarily in order to prevent inbreeding, and therefore an irrelevance in non reproductive relationships)."

He goes on to call his comments "mischievous," but "nonetheless valid,"

Texas Transgender Student Wins Right To Wear Dress And Heels To Prom

"All I wanted was to get to wear a dress to prom, because I wouldn't have felt comfortable at all showing up in a tux," Tony Zamazal (right) is quoted in a press release as saying. "I'm so grateful that my school has agreed to let me be myself on such an important night."

Originally the school (Houston's Spring High School) barred Zamazal from attending the prom in the attire he wanted, which included a dress, wig, make-up and pumps.  Not long after that decision, the school received letters from the national offices of the ACLU, as well as the Texas ACLU, explaining why it was unconstitutional for the school to do this, and the school reversed its decision.

Zamazal's case is merely the latest challenge to high school prom regulations across the country in recent months. Schools in Indiana and Missouri also recently faced challenges from gay students to be able to bring their dates to the prom.

Hate for Anne Hathaway?

"She's annoying."  "She's fake."  "She rubs me the wrong way."  "She's actressy."

The above statements are the opinions of a group of people called "The Hathahaters," a group of people who do not like Anne Hathaway.

The "Hathaway-Hate" began before Anne won her Academy Award this year, and increased in the wake of her acceptance speech at the Oscars.  It went so far as The San Francisco Chronicle’s web site hosting a "Most Annoying Celebrity of 2013" contest, which Anne Hathaway won.

Curiously, the "hathahaters" don't point to a specific thing that Anne has done to deserve such hate, just the fact that they hate her.  The topic has become a subject for many online articles, and discuss why Anne is the target of this online venom.

Uruguay Legalizes Gay Marriage

On April 10th, the Uruguayan Parliament passed the Equal Marriage Act, making gay marriage legal in the prodominatly Roman Catholic country.  It is the second country in Latin America to legalize gay marriage, following Argentina in 2010.

Amnesty International says that this move will bolster human rights protections and make Uruguay a more inclusive country.

Javier Zúñiga, a Special Advisor at Amnesty International, says that,  “The approval of equal marriage and adoption for same sex-couples is supported by Amnesty International’s position that the right to marry and found a family, as set out in international human rights law, should be applied without discrimination, including for same-sex couples.”

This law (which still must be signed by President José Mujica) will also allow same-sex couples to adopt children, allow them to give the child both surnames, and choose the order of the surnames.

French Senate Passes Gay Marriage Bill

On Friday, April 12th, the French Senate passed a gay marriage bill.   The vote came despite boisterous protests. Opponents, mostly conservatives and fervent Roman Catholics, have sought to defend traditional marriage.

The bill would allow gay marriage and let same-sex couples adopt children. On the campaign trail last year, President Francois Hollande pledged to push through such legislation if elected.

Those who oppose the bill refuse to be swayed, and state they wil continue their opposition to it.  France's general population is narrowly in favor of gay marriage, however, when questions of adoption and conception of children enter the debate, the support faulters.

Calls for Obama to Do More

With the Supreme Court involved in both the Prop 8 and DOMA cases, the spotlight is back on President Obama for his support for gay rights.

During his terms as President, Obama has done a lot to show support to the gay community, including working to get Don't Ask, Don't Tell repealed, and his Administration's refusal to defend the Defense of Marriage Act.  He also made public statements that he supports gay marriage.

Gay rights groups want Obama to issue an Executive Order barring federal contractors from discriminating on the basis of sexual orientation, an act that could have sweeping impact.

"There is more that he can do," said Jon Davidson, legal director at Lambda Legal, a non-profit organization supporting lesbian, gay, bisexual and transgender (LGBT) people. "He has repeatedly said as president that it's people's job to push him to do more and more, so we intend to keep doing that."

Gay and Lesbian Characters in Fiction

Author David Astor has an entry on The Huffinton Post website that talks about gay and lesbian characters in fiction.

He begins his article with the fact that 2013 is the 40th anniversary of Rita Mae Brown's 1973 novel "Rubyfruit Jungle".  Astor then goes on to discuss novels that pre-date "Jungle", and goes through the current times.  In his review of stories that contain gay characters, Astor mentions "In Search of Lost Time", "The City and the Pillar ", "The Front Runner","The Color Purple", "Fried Green Tomatoes at the Whistle Stop Cafe", "The Robber Bride" and Ennis and Jack from Annie Proulx's story "Brokeback Mountain"

Isiah Fish is a sophomore creative writing major from Louisville.  He is also this year’s recipient of the 2013 Henry Fiction Award for his short story, “Deciphering Summer.”

Fish sat down for an interview with Rachael Hodge from The English Majors' Weblog, where he answered questions, talked about inspiration, and even mentioned André Aciman and Annie Proulx as authors who inspire him.  In the interview he briefly discusses what aspects of each author's writinig he is drawn to, and talks about his own writing styles as well.

Anne Hathaway & Chris Nolan Team Up Again

Director Chris Nolan worked with Anne Hathaway when she won the part of Catwoman in Nolan's "The Dark Knight Rises", and they may be teaming up agains soon for Nolan's movie "Interstellar".

Nolan is know to be "secretative" about his films, so there are not many details that are out to the public yet.  Nolan will direct, his brother Jonathan will write the script, Matthew McConaughey is also set to star in the film, and the film is a co-production between Paramount Pictures and Warner Bros.

“Interstellar” follows a group of explorers who travel through a wormhole to an alternate dimension. Allegedly the film is based on Caltech astrophysicist Kip Thorne’s scientific theories about time travel and alternate dimensions.

The film has been in the works with Warner Bros. since 2007 when Jonathan Nolan wrote the script. Steven Spielberg was working on the project at one point, but dropped out for unknown reasons. On January 9, 2013 Nolan signed on to rewrite the script. He added some of his own story elements and changed some of the existing plot points.

GLAAD Media Awards 2013

Los Angeles was the host of the 24th GLAAD Media Awards on Saturday night, and one award had a controversial tone due to the recipient.

Former President Bill Clinton (pictured with daughter Chelsea) was given the first Advocate for Change Award, which surprised many people considering that it was during his terms as president that the Defense Of Marriage Act (DOMA) was signed into law, as well as the Don't Ask, Don't Tell (DADT) policy.   On the other hand, he appointed more than 150 gays and lesbians to a variety of government posts, and he also substantially increased federal funding of research into HIV/AIDS.

When he gave his acceptance speech, he credited Chelsea and her friends for helping him change his views, and he looks forward to the day when DOMA is done away with.

Other winners for the evening included the TV show "The New Normal", "American Horror Story: Asylum" and NBC's daytime drama "Days of Our Lives".

The night also featured a number of personal stories that were revealed during interviews.  Actor Justin Bartha talked about his brother's coming out, "Kyle XY" actor Matt Dallas discussed his decision to come out publicly earlier this year. MSNBC news anchor Thomas Roberts discussed his recent marriage to his parter of 12 years, blogger Perez Hilton detailed the challenges of being the single gay parent of a newly adopted child, and transgendered Chaz Bono expressed hopes for the gay lesbian bisexual transgender community's future.

Update on the Boy Scout Ban

The topic of whether or not to allow gays in scouting has become a very divisive issue, and it appears that the BSA (Boy Scouts of America) is looking to compromise, or at least take baby-steps to be inclusive.  A proposal has been motioned on Friday after weeks of deliberations that willl allow gay boys to become scouths.  However, it will not allow those same boys to become Scout Leaders if the opt to stay involved in scouting.  The proposal will be submitted to 1,400 voting members of the BSA National Council during the May 20th meeting in Texas.

The BSA has taken a lot of heat and bad publicity for its stand on gay people being involved in scouting, and as a result has lost sponsorship dollars from donors, until they agree to change their policies.   Pop singer Carly Rae Jepsen (Call Me Maybe) turned down an invite to appear/perform at the yearly jamboree due to the current policy.

The resolution states that:  "no youth may be denied membership in the Scouts on the basis of sexual orientation or preference alone."  Howeer, a ban would continue on leadership roles for adults who are openly gay or lesbian.  Gay-rights groups, which had demanded a complete lifting of the ban, criticized the proposal as inadequate.   Rich Ferraro, a spokesperson for GLAAD,  says:  "Until every parent and young person have the same opportunity to serve, the Boy Scouts will continue to see a decline in both membership and donations."

Nebraska Lesbian Sentenced To Jail

Charlie Rogers, a lesbian and former basketball player alledges that on July 22 of 2012, she was attacked by three masked men who bound her with zip ties, beat her, carved homophobic slurs on her skin, put gasoline on her floor, and lit it with a match.  Police were called after Rogers showed up at a neighbor's house, naked, bleeding and screaming for help.

Investigors say her story quickly fell apart, and that she faked the attack because she thought it would inspire change in the treatment of gay people. They say Rogers purchased zip ties, a box cutter and white gloves shortly before the attack, and that the evidence didn't support what she said had happened.

Rogers was eventually arrested, and on Thursday she was sentanced to a week in jail, and 2 years probation, during which she must undergo psychiatric care.

New Zealand, Gay Marriage, and Singing

On Wednesday, April 17th, New Zealand became the 13th country in the world to legalize gay marriage, with a vote of 77 for and 44 against.  The announcement caused lawmakers and observers for gay marriage to burst into applause and a standing ovation.  Just moments later, they broke into song, singing "Pokarekare Ana," which is a traditional Maori love song.

Not everyone supported this, and those who voted against it quickly left the room.  Customs Minister Maurice Williamson issued a statment to those who were against the passage of this law:  ‘‘I give a promise to those people who are opposed to this bill right now... the sun will still rise tomorrow, your teenage daughter will still argue back with you as if she knows everything, your mortgage will not grow, you will not have skin disease or rashes or toads in your bed. So don’t make this into a big deal, this is fantastic for the people if affects but for most of us life will go on.’’

Pakistan Transgender Community Ready to Vote

Bindiya Rana will be running for office in Pakistan.  While this may not seem like a big deal, Rana is transgendered, and will be the first transgendered person ever to run for office there.  Rana was originally denied the opportunity to run, but an appeal changed that decision.

Rana's campaign is the result of a 2011 Supreme Court ruling. The ruling ordered that the government of Pakistan was obliged to issue identity cards to transgendered citizens - who were previously forced to identify as male on the cards - so that they would be legally allowed to vote. This ruling meant that 500 000 of the nation's Eunuchs and transgendered citizens could now vote and run for office while identifying as transgendered.

The transgendered community is the most marginalized groups in Pakistan, due to the conservative nature of the country.  They are often kicked out of their homes, not entitled to received government benefits, and unable to find work, leaving them to turn to begging in the streets as a way to make money.

Right to Refuse

The National Organization for Marriage (NOM) has taken exception to a recent court decision that was made in Hawaii.

A judge in Hawaii has determined that the owners of a bed and breakfast broke the law when they refused to give a room to a same-sex couple.  NOM has sided with the owners of the bed and breakfast, feeling that they lost their rights to run their business as they want.

“cases such as this one are only more frequent and harder to fight against where marriage is redefined.”

Gustavo Santaolalla’s Overflowing Plate

Gustavo Santaolalla is best known as the composer of Oscar-winning scores for the movies Brokeback Mountain and Babel, but he has a many hats he is wearing lately.

Gustavo is also the co-founder of Bajofondo, a tango-fusion group, and is currently working on a dance-musical, a video game, an animated film, and a winery.  Just before Bajofondo closed out their last tour, Gustavo sat down with Jordan Levin to talk about all his projects.

His gaming adventure is to provide the music for The Last of Us, a post-apocolyptic game that will be coming to Sony Playstation this June.  The animated film doesn't have a title yet, but is based on the Mexican holiday The Day of the Dead.  He has done a song, and the score, and should be opening the end of 2014.  His next project is a live musical version of Pan's Labyrinth, and his musical is a dance show he wrote years ago, about a young girl finding her way to womanhood.

He also has his winery to "help him keep busy."

Jason Collins Comes Out

Homophobia in the locker room had kept him in the closet for the past twelve years, but Jason Collins has decided that the time is right to come out now.

His announcement was meant to start the conversation on gay athletes in pro sports - and the chatter has already begun.

His bombshell announcement - he’s believed to be the first active athlete in a major American professional sport to publicly identify himself as homosexual - has people within the sport, in other sports and throughout the world talking about his revelation.

The Timeless Truth in a Romantic Old Flick

As a society's ideas on sex change, do their ideas on romance also change, or does that remain the same?

Time Out magazine has published their list of the "Top 10 Best Ever Romantic Movies"  and when one reviews it, it seems to indicate that over time, what was considered "romantic" has changed, with the plots of the movies become more daring.

The list is topped by "Brief Encounter" and "Casablanca", which can be descrived as classic "boy-meets-girl" movies.  However, as one goes down the list, the movies become more that tha.  "The Apartment" is on, as is "Harold & Maude" and "Brokeback Mountain".

These movies have plots that include affairs, overdoses, generation gaps (Harold is 19 while Maude is 79) and male-to-male intimate relationships.  These would all be considerd taboo in earlier years, but now these films are considered "romantic classics".  Has the movie viewing audience become more liberal, or is it that while the plots are definitely different, that real romance doesn't change through the years?

GOP Donors Push for Gay Marriage

Gay marriage supporters are getting help from American Unity PAC.  AUP was formed last year, and their goal is to lend financial support to Republicans who bucked the party's longstanding opposition to gay marriage.  AUP founders are launching a new lobbying organization, American Unity Fund, and they have already donated $250,000 in Minnesota, where the Legislature could vote on the issue as early as next week..

The group has been lobbying strong for the past month, and they have spent $500,000 on efforts in Rhode Island, Delaware, Indiana, West Virginia and Utah.

Spokesman Jeff Cook-McCormac told The Associated Press:  "What you have is this network of influential Republicans who really want to see the party embrace the freedom to marry, and believe it's not only the right thing for the country but also good politics."

There are also plans to lobby federal lawmakers on gay rights issues.

"We intend to work on this effort until every American citizen is treated equally under the law," Cook-McCormac said.

Marriage Battle Goes Behind the Scenes

Last year, the Catholic church spent over $650,000.00 in the state of Minnesota to support an ammendment to the state's constitution that would ban same-sex marriage.  Much to the chagrin of church leaders, the voters rallied against the ammendment, refusing to pass it.

Fast forward to current day, and the battle for same-sex marriage.  A vote is expected soon by the state government, and this time, the church is taking a much more quiet approach.  Church leaders are going in 'behind-the-scenes', meeting with legislators and explaining their position, hoping to sway them to vote against same-sex marriage.

The Catholic Church is still active on the issue and pointed to a letter signed by the bishops and more than a dozen leaders of other faiths asking lawmakers to vote against legalizing same-sex marriage. Catholic leaders across the state are encouraging the faithful to contact their legislators to urge them to vote no.

Jake Gyllenhaal in "Nightcrawler"

Before you jump to any conclusions....no this is not a super hero movie, it has nothing to do with the X-Men character Nightcrawler.

The movie, written by Dan Gilroy, will feature Gyllenhaal as a young journalist who is trying to make his way in the world of freelance journalism.  We don't have much more information, but since this is billed as a thriller, we can assume that some bad things happen along the way for him.

Gyllenhaal hasn’t been on the big screen since the 2012 cop drama End of Watch. However, the actor is looking to change all of that very soon.  He was last seen on the big screen with End of Watch.

NOM Labeled "Ineffective"

Rhode Island Governor Lincoln Chafee said he will sign a bill legalizing same sex- marriage as soon as this week, and this success for same-sex marriage has caused foes to turn on NOM, claiming that they were ineffective in halting the success of the movement in Rhode Island.

Rhode Island is one of the few states where NOM has set up a permanent chapter, which is headed by Chris Plante (pictured at left).

“NOM seemed to view Rhode Island as an afterthought. When their representative there, Chris Plante, was unfortunately sidelined with medical issues during much of the last several months, NOM didn’t bother to send help. As a result, NOM did no serious organizing or strategic planning.  Meetings with activists would be set up, then go unattended.”

Instead, NOM acted as the 'official' pro-family voice before the Rhode Island media, doing many interviews, etc. And they funded some media advertisements, robo-calls, and email blasts. When public hearings came up, they helped line up quality speakers, but had no NOM representative testify.”

Thread Spotlight Section

This week's TDS will turn the spotlight on the "Brokeback Mountain Memorabilia  " thread.

This thread has been rather busy lately.  Recent posts by BayCityJohn, Morrobay, Heath4Ever show that Brokeback items still turn up on various sites, and can be yours if you're willing to spend the money.

However, the forum doesn't endorse any specific sellers, and warns members to be careful when purchasing items, autographs can be forged/faked, as can "certificates of authenticity".
